Title VI Civil Rights Act and Policy Notification

The U.S. Congress signed the Civil Rights Act in 1964 and the Civil Rights Restoration Act in 1987. Title VI of the Civil Rights Acts prohibits discrimination based on race, color, or national origin in all benefits and services provided by government agencies. Title VI of the Civil Rights Act of 1964 requires recipients of federal financial assistance to guarantee its programs and activities provide for effective participation by persons who may be impacted by the City’s decisions.

As participants in the public involvement process, we need your help in gathering demographic information. Completing the form will enable us to document whether our public involvement process includes the affected populations. Completing the form is voluntary; you are not required to complete the form to participate in this meeting.

Anyone who believes they have been excluded from participation in, denied the benefits of, or otherwise subjected to discrimination under any City of Kent program or activity because of their race, color, or national origin, may file a complaint.

Complaints must be filed no later than 180 days from the last date of the alleged discrimination. Complaints may be received via the City’s online complaint form and must be electronically signed.

WHAT HAPPENS AFTER A COMPLAINT IS FILED?

Once a complaint is received, the City of Kent will review it to determine if our office has jurisdiction. The complainant will receive an acknowledgment letter informing him/her whether the complaint will be investigated by our office.

If the complaint has investigative merit, the Title VI Coordinator will assign an investigator. The City of Kent has 90 days to investigate the complaint. If more information is needed to resolve the case, the investigator may contact the complainant. The complainant has 30 business days from the date of the letter to send requested information to the investigator assigned to the case. If the investigator is not contacted by the complainant or does not receive the additional information within 30 business days, the City of Kent can administratively close the case. A case can also be administratively closed if the complainant no longer wishes to pursue their case.

After the investigator reviews the complaint, one of two letters will be issued to the complainant: a closure letter or a Letter of Finding (LOF). A closure letter summarizes the allegations and states that there was not a Title VI violation. This means the case will be closed. An LOF summarizes the allegations and the interview regarding the alleged incident. It explains how the situation will be addressed, and whether any disciplinary action, additional training of the employee, or other action will occur. If the complainant wishes to appeal the decision, he/she has 90 days after the date of the letter or the LOF to do so.

If your complaint is forwarded to another agency, you will be provided the name and contact information of the employee handling your complaint.

Federal law prohibits retaliation against individuals because they have filed a discrimination complaint or otherwise participated in a discrimination investigation. Any alleged retaliation should be reported in writing to the investigator.

FHWA will render final decisions in all cases including those investigated by WSDOT. There are no administrative appeal forums in Title VI complaints. Once FHWA issues its final agency decision, a complaint is closed.

There is no prohibition against a complainant filing a Title VI complaint simultaneously with an LPA, WSDOT, and FHWA.

WHAT IF I DON’T AGREE WITH THE DECISION?

The notification of the final decision will advise the complainant of his/her appeal rights with WSDOT and USDOT if he/she is dissatisfied with the final decision rendered.

¿QUÉ SUCEDE DESPUÉS DE PRESENTAR UNA DENUNCIA?

Una vez que se recibe una queja, la Ciudad de Kent la revisará para determinar si nuestra oficina tiene jurisdicción. El denunciante recibirá una carta de acuse de recibo informándole si la denuncia será investigada por nuestra oficina.

Si la denuncia tiene mérito investigativo, el Coordinador del Título VI asignará un investigador. La ciudad de Kent tiene 90 días para investigar la denuncia. Si se necesita más información para resolver el caso, el investigador puede comunicarse con el denunciante. El denunciante tiene 30 días hábiles a partir de la fecha de la carta para enviar la información solicitada al investigador asignado al caso.
